What Is Possession Day? Understanding the Final Step Before You Get Your Keys
Closing, Ownership Transfer, Mortgage Funding and Key Handover Explained
Possession Day is the day the transaction actually completes and the buyer becomes entitled to take possession of the home—provided the legal and financial steps of closing have been successfully completed.
Buyers often think of possession day only as “key day,” but several things have to happen behind the scenes first. The buyer’s lawyer must receive funds, the lender must advance mortgage money if applicable, the seller’s lawyer must receive and process the money, title documents must be handled and the parties’ closing instructions must be satisfied before keys are released.
In Alberta resale transactions, the standard purchase contract used by REALTORS® links completion, full payment of the purchase price and vacant possession to the contractual Completion Day. The form states that this happens at 12 noon, but in practice buyers often receive keys later in the day once the transaction has actually closed.
This article explains what possession day means, who does what, how remaining funds are paid, why delays happen and how possession works a little differently for new homes built by a builder.
Possession, completion, closing and title transfer are related—but not identical
These terms are often used together, but they do slightly different work. Completion or closing refers to the legal and financial completion of the purchase. Possession refers to the buyer taking control of the property and getting the keys. Transfer of title refers to the registration process that legally records the buyer’s ownership interest in the land-title system.
In everyday conversation, people often treat these terms as interchangeable. That is understandable, but it can create confusion. On a practical level, the important point is this: the buyer usually gets keys only after the transaction has closed successfully in accordance with the agreement and the instructions between the parties’ lawyers.
A practical possession-day timeline
This timeline shows the normal sequence of closing-day activity. Exact timing varies from one transaction to another, but the structure helps explain why moving plans should leave room for delays.
The responsibilities of each party on possession day
How the remaining funds are paid
By possession day, the buyer usually has already paid a deposit. The buyer then provides the balance of the required cash—such as the rest of the down payment, adjustments and closing costs—to their lawyer ahead of closing. If there is a mortgage, the lender advances the mortgage funds through the buyer’s lawyer as part of the closing process.
The seller’s lawyer receives the closing funds, deals with payouts and discharge requirements where necessary, and coordinates the completion of the transaction. Only when the legal and financial steps are satisfactorily completed can the release of keys happen.
Typical items due before closing
Buyer’s remaining down payment, legal fees, title-related costs, adjustments for taxes or utilities where applicable, and any lender-required cash to close.
Why mortgage pre-approval is not enough
Pre-approval helps with planning, but the lender still needs the file to move through final underwriting and funding. If an issue arises late, possession can be delayed.
Why possession can happen later than expected
That is why buyers should avoid booking movers, elevator reservations, trades or large deliveries too tightly around noon. A flexible schedule creates less stress and fewer extra charges if keys are released later than hoped.
How possession differs between a resale home and a newly constructed home
Completed resale property
The home already exists in finished form, and the contract typically sets a specific Completion Day. The focus is on legal closing, vacant possession and transfer logistics. Timing still matters, but the physical home is already built.
Newly constructed home
Possession depends not only on financing and legal closing, but also on the builder’s construction timeline and completion readiness. Delays can arise from inspections, trade scheduling, weather, material timing or other completion-related issues.
With a new home, buyers should understand that possession is connected to the builder’s completion schedule. Even when the home is nearly ready, there may still be coordination around occupancy readiness, final paperwork and handover timing. That does not necessarily mean something has gone wrong; it simply reflects that construction-based transactions have an additional operational layer beyond a typical resale closing.
What buyers should arrange before possession day
- Send the required closing funds to your lawyer well before the deadline provided.
- Confirm homeowner insurance is in place by the required date.
- Arrange utility accounts and internet setup with realistic timing.
- Keep government ID, banking documents and lawyer instructions organized.
- Leave flexibility with movers and any same-day deliveries.
- Do not assume keys will be available exactly at noon unless specifically confirmed after closing is complete.
